Management advice!
My wife and I started a community school and we have been running the school as directors since 2014. In 2023, we got an intetnational Ngo that helped with agrant to build 3 class rooms. This ngo works with a local private company to send in its grant money to our school in four installements. The intetmediate company after completing the 3 room block, disguised to send another extra instalment which is partly used to finish the teqchers houses. We later discovered it was money extra and decides to send back this money to them. The intermediary requires us to send the money with interest and our struggles begin.. we payd back upbto 40% untill we have no income to continue paying. We have failed to run the school and urtery evrything has been destroyed, no income and doing farming to survive and our children are droping out of school. The Ngo is pushing to throw us away witbout any thing we take home. The ngo is intetnational and it hides behond this local company to do silent impounding/ forcefully buying the school.

We have no job as the school has been discontinued due to this problem. We have no legal presence and we would like to lean on tbis platform for some intellectual advice.

if some CEO here have gone through such times we will be happy to learn from you all and what should be our route out of it!

    Who bought the land where the school is situated. i mean in whose name is the land agreement registered. what were terms of engagement between you and... the NGO. Good to revise it. Did you sign any document before receiving the grant? If yes did you understand the terms and conditions very well. My advise then is carry every document and seek the opnion of a legal person to understand the engagement terms and conditions. If the land belongs to you then you have a better ground to argue. By the way who has been paying teachers. If at all they are the ones paying and meeting the running costs then it could be better to seek support of the authorities in mediating both of you and perhaps have a fresh beginning. I say all this believing in what you stated. however there are also people whom agencies hire to put up community project and because they are at the fore front, they later want to personalise projects. if you are such then you need to re think your intent.  more

  • Legal advice has a cost that you cannot afford at this time.
    My first reaction is that the international co cannot have such devious behavior and... stay in business. The intermediary introduced you to the other guy and handled the transactions. If they were not appropriate, unless they are involved or naive, they should have at least cautioned you. You may want to reexamine the issue and see who deserves the blame.
    And, if you received more than expected, why did you not return it? Was it manna from heaven? You may want to reassess your own contribution to this mess. You probably signed some loan papers that should have raised a flag in your mind.
    Anyway, now that you are stuck, how do you get out of it? Determine the blame first and then get tough. Let them know that it was unsolicited loan, you cannot afford it and, without significant relief, you may be forced into bankruptcy. Credit advisory outfits can guide you better.. If you need legal advice, try Legal Aid first. Good luck.
