About a week and a half ago the head of our department really started feeling sick, went home and said she was put on sick leave. But the very next day she still came to work with a fever and a cough and barely managed to get through the day. Because she was worried that we wouldn’t cope with the project. After that, three more employees got sick and now I’m the only healthy person left working in the department.
Could you please tell me if there is any legislation that forbids sick employees from coming to work and infecting their colleagues? Thank you

    The workers Act, Employment Act, All labor laws plus human rights can't allow any employee to work when he/she is sick.
    It even contradicts with the... mother law.

  • In Kenya, there is no single law that says “a sick employee is forbidden from coming to work” in all cases.
    However, there are laws that require... employers to prevent situations where sick employees endanger others—especially when there’s a risk of infection.
    So while your colleague may not have technically “broken the law” by showing up, your employer may be failing in their legal duty.

People & Infected Items Could Covertly Cause A Spread Of What Ever This Bug Is. This Person Could Be The Weakest Immuned Body & Reacted Wuicker Than Most, The Others Then Followed.   • I doubt if there is such a law or legislation but as soon as an employee reports sick he should be exempted from work upon application for sick leave... pending the time he will be okay and resume work. Being in the office while confirmed sick is hazardous to the well-being of the rest of the staff. He should equally know that, no one is indispensable  more

  • Humanely, they're not supposed to work as they're not well, sober and probably not fit at all to withstand the work pressures and requirements. The... department needs to ensure they get rightful treatment as immediate as possible, health insurance must be available for its workers. more
