Seeking specialized legal advice!

Hi all, Sylvia and I are school directors who came here for advice. An international NGO gave us a grant to construct class rooms which was done. a school had a loan from a private partner which helped to raise teachers houses. when we could not pay in time the loan, we requested the Ngo to help repay then the school would settle the ngo funding in presure free arangement. the Ngo did pay the Money lender. unfortunately the money lender hard hurriedly transferred the school title into his names.
the NGO and the money lender forced a sale between themselves stating that it was the lender selling to the NGO. The sales agreement included the grant monies, the money paid to the lender, and paid us nothing.
The NGO is throwing us out claiming we have no legal rights.

we got advice here to go to Legal Aid since we have no means for the legal cost in this matter. However we had contacted one Lawyer, who advised that we hold a mutual meeting with the NGO and us before, when we tried to invite a meeting, the NGO told us we have no legal rights!
The NGO representative here cause hard sales and assets arr written in his company names, not thengrant giving NGO. Since they know local people have no much capacity for legal processes tjey force such harsh situations upon vivtims.

we are here to seek more advise if any one has more information on how international NGOs could be of help to communities efforts not to end in grabbing property they have not appropriately bought!

Thank you for your kind advice and support.
Richard & Sylvia.

  • Thank David,
The school loan was from a private individual and not a bank. The school didn't get a legal notice for the transfer of title. We have ... got a lawyer who will straighten this matter for our future survival. Thank you very much for your kind advice.
    Richard.

  • This matter needs to be well understood, as per terms of the loan with the bank, the school land was part of the sureties. Had the loan been... defaulted and a legal notice pertaining transfer of property been issued to the school? If yes, then the transfer is legal and enforceable. But on the conditions agreed upon between the bank and the school.
If not, then the international NGO obtained a wrong title, its upon this that the school should sue the bank and identify under which conditions the transfer was made.
