The article outlines the circumstances under which the substantial transfer of economic operational risk from the contracting authority to the concessioner occurs. This discussion starts from a recent case called Sharengo that appeared at CJEU from Slovenia. A concession services contract was about to be concluded in relation to with the rental and sharing service of EVs as mean to implement a public policy for sustainable urban mobility. This is the reason we also touched upon the current legal framework of sustainable urban mobility at EU and Romanian level to consider that maybe such model could be implemented in the future in Bucharest as a new sustainable urban mobility plan is expected to be put in place in Bucharest.
